StoryStudio Terms of Service

StoryStudio is provided by Elvin Vargas JR.

In these Terms, “StoryStudio,” “StoryStudioAI,” “we,” “us,” and “our” refer to the StoryStudio service and its operator, as applicable.

Questions about the service or these Terms may be sent to the support contact listed at the end of these Terms.

You must be legally capable of agreeing to these Terms and must satisfy any minimum age requirements that apply in your location.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs through your StoryStudio account.

You must provide accurate account information and promptly protect or change your credentials if you believe your account has been compromised.

You may not:

• Impersonate another person.
• Access another user's account without authorization.
• Attempt to bypass authentication, subscription requirements, or access controls.
• Share credentials in a manner intended to circumvent subscription or security restrictions.

You retain ownership of the creative content you create, upload, enter, or store in StoryStudio, including manuscripts, screenplays, story ideas, characters, locations, outlines, timelines, Story Bible entries, notes, scenes, chapters, relationships, creative planning materials, and other original creative content.

Collectively, these materials are referred to as Your Content.

StoryStudio does not claim ownership of Your Content merely because you store or process it through the service.

You grant StoryStudio a limited, non-exclusive license to host, store, copy, process, transmit, display, and otherwise use Your Content only as reasonably necessary to operate, secure, maintain, and provide the features you request.

This operational license ends when the relevant content is deleted from the active service, subject to reasonable backup, security, legal, fraud-prevention, and disaster-recovery retention.

You are responsible for Your Content and for ensuring that you have the rights necessary to upload, store, process, or publish it.

You may not knowingly use StoryStudio to store or distribute material that violates applicable law or the intellectual property, privacy, publicity, or other rights of another person.

StoryStudio is a creative development tool. It does not independently verify whether your writing, ideas, references, names, characters, settings, images, or other content infringe third-party rights.

You remain responsible for reviewing your work before publication or commercial use.

StoryStudio may provide optional AI-powered features, including AI Copilot.

AI features are not required to use StoryStudio's non-AI writing and planning tools.

When you intentionally use an AI feature, relevant prompts, instructions, and project context may be transmitted to the AI provider you have configured in order to generate the response you requested.

AI-generated output may be:

• Inaccurate.
• Incomplete.
• Inconsistent.
• Inappropriate.
• Factually incorrect.
• Similar to content generated for other users.
• Unsuitable for publication or commercial use.

You are responsible for reviewing AI-generated material before relying on it, publishing it, submitting it, or incorporating it into your work.

StoryStudio does not guarantee that AI output is original, unique, factually correct, legally protectable, non-infringing, or suitable for any particular purpose.

StoryStudio uses a bring-your-own-AI-provider model for AI Copilot features.

To use supported AI features, you may be required to connect your own account or API credentials from a supported third-party AI provider, such as OpenAI.

Your StoryStudio subscription does not include the fees charged by your AI provider.

Any API usage fees, credits, usage charges, account fees, or other charges assessed by an AI provider are separate from your StoryStudio subscription and are your responsibility.

StoryStudio does not control the pricing, billing policies, rate limits, account requirements, availability, or terms imposed by third-party AI providers.

You are responsible for:

• Maintaining an active AI provider account when required.
• Maintaining sufficient provider credits or billing arrangements.
• Complying with the provider's terms and policies.
• Monitoring charges imposed by the provider.

Disconnecting or losing access to an AI provider may prevent AI Copilot from functioning, but does not automatically cancel your StoryStudio subscription.

StoryStudio may impose application-level limits on how often AI Copilot may be used.

These are StoryStudio platform limits and are separate from any limits or charges imposed by your AI provider.

StoryStudio may also apply reasonable:

• Daily limits.
• Short-term rate limits.
• Abuse-prevention limits.
• Security controls.
• Technical restrictions.

Unused AI request allowances do not roll over unless StoryStudio expressly states otherwise.

StoryStudio may adjust plan limits in the future. Material changes affecting an existing paid subscription will be handled in accordance with applicable law and payment-processing requirements.

You agree not to misuse StoryStudio.

Prohibited conduct includes:

• Attempting to gain unauthorized access to StoryStudio, another user's account, private projects, databases, servers, or infrastructure.
• Circumventing or attempting to circumvent rate limits, subscription limits, authentication, Row Level Security, AI usage controls, or other technical restrictions.
• Introducing malware, destructive code, automated abuse, denial-of-service traffic, or other activity intended to disrupt StoryStudio.
• Using automated systems to place an unreasonable load on the service without written permission.
• Attempting to obtain private server credentials, encryption keys, payment secrets, API credentials, or other protected information.
• Reverse engineering proprietary components except where such restriction is prohibited by applicable law.
• Using StoryStudio in a manner that violates applicable law or the rights of another person.
• Using another person's AI provider credentials without authorization.
• Attempting to evade subscription fees or usage restrictions.

StoryStudio may provide:

• Autosave.
• Writing snapshots.
• Version history.
• Project backups.
• DOCX export.
• PDF export.
• Other data portability features.

These features are intended to reduce the risk of data loss, but they are not a substitute for maintaining your own independent backups.

You are responsible for keeping offline copies or additional backups of manuscripts and creative projects that you cannot afford to lose.

StoryStudio does not guarantee that every edit, version, export, backup, or deleted item can always be recovered.

StoryStudio may change, add, remove, improve, suspend, or discontinue features from time to time.

The service may occasionally be unavailable because of:

• Maintenance.
• Software errors.
• Infrastructure failures.
• Third-party provider outages.
• Security incidents.
• Upgrades.
• Internet outages.
• Events outside StoryStudio's reasonable control.

StoryStudio does not guarantee uninterrupted, error-free, or permanent availability of every feature.

StoryStudio is a paid subscription service.

StoryStudio currently offers paid plans including Early Access and Pro.

Current pricing, billing intervals, included features, and plan-specific AI allowances are displayed on the StoryStudio billing page and during Stripe Checkout.

StoryStudio does not currently provide a general free product tier.

Creating an account without an active subscription does not automatically grant access to paid StoryStudio project features.

StoryStudio subscriptions may be offered on a monthly or annual basis.

The amount presented to you at Checkout controls if it differs from pricing stated elsewhere.

By purchasing a recurring subscription, you authorize StoryStudio's payment processor to charge the payment method associated with your subscription at the price and billing interval shown at Checkout, plus applicable taxes.

Monthly subscriptions generally renew each month.

Annual subscriptions generally renew each year.

Subscriptions continue renewing until canceled.

Your billing date may vary because of payment failures, billing adjustments, payment processor rules, or other circumstances.

StoryStudio subscriptions automatically renew unless canceled.

By subscribing, you authorize recurring charges until you cancel your subscription.

You are responsible for canceling before your next renewal if you do not want to be charged for another billing period.

StoryStudio may change subscription prices or plan features in the future.

Where required by applicable law or payment-processor rules, StoryStudio will provide notice before a pricing change applies to an existing recurring subscription.

StoryStudio uses Stripe to process subscription payments and provide services such as:

• Checkout.
• Invoices.
• Payment processing.
• Payment-method management.
• Subscription management.
• Customer billing portals.

StoryStudio does not receive or store your full payment card number or card security code.

Payment information is submitted directly to and processed by Stripe under Stripe's applicable terms and privacy practices.

You are responsible for providing accurate billing information and maintaining a valid payment method when required.

Stripe or your financial institution may decline or delay payments independently of StoryStudio.

Prices displayed by StoryStudio may exclude applicable:

• Sales tax.
• Use tax.
• Value-added tax.
• Similar governmental taxes.

Taxes may be calculated and collected during Checkout when required.

The final amount presented by Stripe before you submit payment is the amount you authorize to be charged.

You may cancel your StoryStudio subscription using the billing-management tools provided to your account.

If cancellation is scheduled for the end of your current billing period, paid access generally remains available until the end of that paid period.

Your subscription will not renew after the scheduled cancellation date.

Canceling a subscription does not automatically delete your StoryStudio account or your creative projects.

Account deletion is a separate action.

When your paid subscription ends, expires, or is canceled, access to subscription-required StoryStudio features may be restricted.

StoryStudio currently attempts to preserve the projects and creative data associated with your account after paid access ends so that your work may become accessible again if you later resubscribe.

Ending a subscription does not, by itself, mean that StoryStudio immediately deletes your projects.

However, StoryStudio does not promise indefinite storage of data associated with inactive or unsubscribed accounts.

StoryStudio may establish reasonable retention, archival, inactivity, or deletion policies in the future.

If such a policy would materially affect stored customer projects, StoryStudio may provide reasonable notice where practical or required by law.

You should export or independently back up any work you cannot afford to lose.

If you resubscribe while your retained projects remain available, StoryStudio may restore access to those projects.

Except where required by applicable law, payments are non-refundable once charged.

StoryStudio generally does not provide prorated refunds or credits for:

• Partially used billing periods.
• Unused AI request allowances.
• Failure to use the service.
• A decision to stop using StoryStudio before the end of a paid period.
• Loss of access caused by a customer's AI provider account.
• AI provider outages or provider billing issues.
• Voluntary account deletion.

If StoryStudio expressly offers a refund, credit, promotion, guarantee, or trial under separate written terms, those specific terms control for that offer.

Nothing in this section limits refund rights that cannot legally be waived.

If Stripe cannot successfully collect a subscription payment, StoryStudio may:

• Retry the payment.
• Request an updated payment method.
• Restrict paid features.
• Suspend subscription access.
• Cancel the subscription.

Your projects are not automatically deleted solely because a payment fails.

StoryStudio depends on third-party services to provide certain functionality.

These may include:

• Supabase for authentication, database, and backend infrastructure.
• Stripe for payment processing and subscription management.
• OpenAI or other AI providers selected or connected by customers.
• Hosting, domain, email, security, analytics, or infrastructure providers.

Third-party services have their own terms, privacy policies, pricing, availability, limitations, security practices, and technical requirements.

StoryStudio does not control and is not responsible for third-party services to the extent permitted by applicable law.

StoryStudio's handling of personal information, account data, AI-provider information, and creative project data is described in the Privacy Policy.

By using StoryStudio, you acknowledge that information will be processed as described in the Privacy Policy and as reasonably necessary to provide the features you request.

The current Privacy Policy is available at storystudioai.net/privacy.

StoryStudio may provide controls for deleting individual projects and permanently deleting your entire account.

Permanent deletion is destructive and generally cannot be undone.

You are responsible for exporting or backing up any material you wish to retain before confirming deletion.

Deleting a StoryStudio account is different from canceling a subscription.

If an active subscription is associated with an account being permanently deleted, StoryStudio may attempt to cancel that subscription immediately before completing account deletion.

If StoryStudio cannot safely confirm cancellation of recurring billing, it may stop the account-deletion process rather than delete the account while recurring billing may remain active.

StoryStudio may retain limited information after deletion where reasonably necessary for:

• Legal compliance.
• Payment records.
• Fraud prevention.
• Security.
• Backup rotation.
• Dispute resolution.
• Tax records.
• Enforcement of these Terms.

StoryStudio may suspend, restrict, or terminate access when reasonably necessary to:

• Protect StoryStudio.
• Protect users or third parties.
• Investigate suspected abuse.
• Enforce these Terms.
• Address security risks.
• Comply with legal obligations.
• Address nonpayment.
• Prevent fraud or technical abuse.

Where reasonable and legally permitted, StoryStudio may provide notice or an opportunity to resolve an issue before permanent termination.

StoryStudio's application, branding, software, interface, documentation, designs, systems, and other service materials are owned by or licensed to the StoryStudio operator and may be protected by copyright, trademark, and other applicable intellectual property laws.

These Terms do not transfer ownership of StoryStudio's software, branding, trademarks, or proprietary technology to you.

Your ownership of Your Content remains governed by the sections above.

If you voluntarily provide product ideas, feature requests, bug reports, suggestions, user-experience feedback, or other feedback about StoryStudio, you allow StoryStudio to use that feedback without restriction or an obligation to compensate you.

This provision does not give StoryStudio ownership of your manuscripts, stories, characters, screenplays, creative worlds, or other project content.

StoryStudio provides creative-writing, planning, organization, and AI-assisted creative tools.

StoryStudio and its AI features do not provide:

• Legal advice.
• Financial advice.
• Medical advice.
• Tax advice.
• Publishing advice.
• Literary-agent advice.
• Investment advice.
• Other regulated professional advice.

You should consult an appropriate professional when you need advice concerning rights, contracts, publishing, copyright, taxes, business decisions, or other professional matters.

To the maximum extent permitted by applicable law, StoryStudio is provided on an “as is” and “as available” basis.

StoryStudio disclaims warranties of:

• Merchantability.
• Fitness for a particular purpose.
• Non-infringement.
• Accuracy.
• Availability.
• Reliability.

This disclaimer does not apply where prohibited by law.

To the maximum extent permitted by law, StoryStudio and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of StoryStudio.

This includes loss of:

• Profits.
• Business.
• Revenue.
• Reputation.
• Data.
• Manuscripts.
• Screenplays.
• Creative projects.
• Creative work.
• Other intangible losses.

To the maximum extent permitted by law, the aggregate liability of StoryStudio and its operator for all claims arising out of or relating to StoryStudio or these Terms will not exceed the greater of:

1. The amount you paid to StoryStudio during the twelve months immediately preceding the event giving rise to the claim; or
2. US $100.

Some jurisdictions do not allow certain exclusions or limitations of liability.

Nothing in these Terms limits rights that cannot legally be limited.

To the extent permitted by applicable law, you agree to be responsible for claims, losses, liabilities, and reasonable costs arising from:

• Your unlawful use of StoryStudio.
• Your material violation of these Terms.
• Your infringement of another person's rights.
• Your Content where you did not have the legal right to use that content.

These Terms are governed by the laws of Georgia, United States, without regard to conflict-of-law principles, except where mandatory consumer law requires otherwise.

To the extent a dispute may lawfully be required to proceed in a particular forum, you and StoryStudio agree to the jurisdiction of courts of competent jurisdiction located in Georgia, United States, subject to any mandatory consumer rights that apply in your location.

StoryStudio may update these Terms as the product, business model, subscription structure, AI integrations, service providers, legal requirements, or features change.

The effective date at the top of these Terms will be updated when the Terms change.

If a change materially affects your rights, StoryStudio may provide additional notice where appropriate or required.

Continued use of StoryStudio after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

If any provision of these Terms is found unenforceable, the remaining provisions will remain effective to the extent permitted by law.

A failure to enforce a provision of these Terms does not waive the right to enforce it later.

These Terms, together with the Privacy Policy and any plan-specific, promotional, or purchase-specific terms presented to you, form the agreement governing your use of StoryStudio.
